My sister in India may be getting married to a US citizen..she would like to apply for a tourist visa first so she can come stay in the US and spend some time with him before her marriage.
If she applies for a tourist visa, stays in the US for a month or so and then later they apply together for a fiance/K3 visa, are there going to be problems for the K3 visa application considering that she had just applied for a tourist visa before? Is it better to not apply for the tourist visa in this case? Thanks...

If you ram into US with a B1/B2...then great they will made deal with you...however one thing
be careful about...if the marriage is soon after you enter US and can complain of the false intent in the B2 entry...

Yes, you can use it for multiple entries (The I-512L should say "this is valid for multiple entries" or something to that effect). But, please be prepared to answer the questions (if any) on what is the necessity to travel on an AP 3 times within the year. If it is on business, that is perfectly within the stated rule. But, if it is vacation, you may be questioned (that is dependent on the individual officer).

Not sure if I posted this on right forum....
I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.
Question: does going on short term disability and getting benefits from the state have any adverse effect on the immigration process?

Hello There,
I want to apply for my 3 yrs H extension using preminum processing. Can i do that by just using the email confirmation from USCIS that I-140 petition was approved? My 1-140 petition was approved in Dec,2006 and still have not recived my approval notice.

If I recall correctly, you need to send a copy of approved i140 to request 3 years extension.

I don't get it - how can USCIS take a sample of 250 people out of the 65000 visas alotted and say that 21 % of them were fraud ( 13% totally and 8 % technically ) . Its like taking only the fraud cases out of thousands and then saying that there is 100% fraud. I bet the fraud cases are not as high as 20% that the author and USCIS say.
It is sad to see that although we H1b immigrants get paid more than the American people ( considering what the employer gets from the client ) and even then we have to hear that we are lowly paid. Speaking from my point of view I know I am paid far more than my american counterparts in the same job profile.

The DREAM Act could come up for a cloture vote as early as this week, but faces tough opposition from Republicans -- including a few who, like McCain, previously supported the bill.
Some will likely vote against the DREAM Act citing timing. Senate Majority Leader Harry Reid (D-Nev.) plans to bring up the bill for a cloture vote as early as Wednesday, but all 42 Republican senators have said they would filibuster any bills not related to tax cuts.
As the Senate struggles to come to agreement on the tax cuts and other issues, the DREAM Act could lose its few Republican supporters. Sen. Richard Lugar (R-Ind.), a co-sponsor of the DREAM Act, would vote against the bill if it came up this week, spokesman Mark Helmke said.
"You have to handle the spending bills, tax legislation and START first," Helmke said. "If we get those three things, he's willing to stay in and take up the DREAM Act."

Hi,
I am working under H1B visa and got married December last year. My wife applied for her H4 visa this month and when she got to the embassy for the interview, the consul checked and commented on the font size of her address in our marriage certificate. She said it was smaller than my address (well, she got a longer address before we got married, maybe that is why the census made it smaller) and said to my wife that it needs verification. The embassy then took all documents (her passport, our original marriage cert, etc.) and said they will call her when she needs to return for interview again.
Has anyone of you experience this? If so, any ideas how long it takes for them to call? BTW I'm Filipino. Thank you guys and God bless

i won the DV lottery last year and am waiting to be called
as they lottery notification papers tell you - continue with all other immigration petitions.
the petitions are completely separate - take the GC with the petition that is adjudicated first and that's what I plan to do.
