I recently got a denial on my audited labor case after 2 years of wait. I had already applied my H1-B 8th year extn on the basis of my pending labor in premium mode. My luck was such that my labor was picked up and denied a day after the H1-B extn was filed.
Questions?
Since the basis of the H1-B extension was pending labor, I think USCIS will reject the extension unless I get lucky.
If I appeal against the denial, is it possible to go back to USCIS to give the H1-B extension on that basis?
DOL site says "standard appeals" is Aug 2007. Does this mean cases of 2007 or appeal filed in 2007 for an earlier denial?
Reason for denial of labor:
Company name was not filed in job advertisement
Job location not specified in the ETA form.
These seem too trivial but nevertheless they sent this in the denial.
My company is looking into the paper work to determine that the above information was mentioned in the application?
Your help/input is highly appreciated in this

Hi
I am planning to apply for new PERM under EB2.
Just checking during these days, how long it takes for PERM approval.
Pls update the timing if you or your friends got the approval in EB2.
Thanks
Around 10 months if your case is not audited and over 2 yrs if audited.

I am currently in L1B status and filed for AOS (I-140/I-485) in July 2007. My I-140 was approved last week and 180 days of pending I-485 are also over. My question is whether there is a huge risk involved in porting to a new employer using EAD, particularly because I do not have any other safety net like H1-B status. I understand, in case of I-485 denial, I will not have any other option to fall back upon. But if USCIS mistakenly issues a NOID or denial for some strange reason, would I have any other option to appeal without going out of country. Can I continue appealing such a potential denial from outside of USA and come if they reopen the case.
More specifically, I have heard some of the AC21 cases have been mistakenly denied or a NOID issues due to ignorant USCIS immigration officer. Can something be done to revive the AOS when there is no backup option like H1B? Would that action needs to be continued from outside of USA or can be done here itself.

conservative columnist and former Bush speechwriter David Frum would like to see three more concessions on the DREAM Act to get conservatives to agree to the bill - http://andrewsullivan.theatlantic.com/the_daily_dish/2010/12/middle-ground-on-dream.html: Here would be my three main suggestions: 1) Lower the age of entry into the US. Even the new versions of the law extend amnesty to people who entered the US up to age 16. That allows too many people who entered on their own impetus rather than as part of a family group and too many people whose first language will never be English. Id lower to 12, to...

Hello All,
I am stuck in a very painful scenario right now. I am working on F1-OPT which ends on Feb 5th 2011 and have a pending H1-B application under premium processing. The thing is my employer says that they will terminate me on Feb 4th and cannot guarantee a rehiring even if H1-B is approved.
My employer needs to know if there is something (legal) like temporary termination and rehiring ? If yes then what does the employer need to do to rehire. And is there any documentation about this. My employer wants to check this documentation before reconsidering.
Any inputs would be appreciated.
Thanks
sak.

If you maintain residence here and continue to pay taxes, I think this is doable. You will have to ask USCIS for permission to stay out of the country for about three years.

The U.S. Embassy in Mexico City has suspended processing of the approximately 5100 non-immigrant visa appointments scheduled Monday, April 27 through Wednesday, April 29. In the US, All USCIS offices remain open for business. Applicants should plan to attend all previously scheduled appointments, interviews and ceremonies unless they are feeling ill. It seems that re scheduling due to illness is a perfectly acceptable reason.
There are no reports of problems to enter the US from Mexico, no refusals due to Swine Flu issues as of now. But this may well change as the issue develops.

From the Houston Chronicle: More Texas voters think unauthorized immigrants should be allowed to stay in the United States through either a path to citizenship or work visas than favor deporting them, according to a new Houston Chronicle/San Antonio Express-News poll. The poll showed that 38 percent of respondents favoring deportation drawing the most support of the three options offered. Twenty-nine percent favored a way for unauthorized immigrants to attain citizenship, while 23 percent supported work visas.

Folks,
Today (06/27/2008) is Bill Gates last day as Microsoft Chairman. As a good will gesture let us all send him a greeting card wishing him good luck. He has been a champion for our cause and we owe him one.
A hand written personal greeting card will be a good idea (no e-cards please)
A short note regarding our issues will not be a bad idea, also do not forget to put ImmigrationVoice.org in your signature! Thousands of cards with IV signature will also help IVs exposure :)
I request ADMIN to have this thread on top so many IVans can send cards to Mr.Gates.
This is the best contact I got, if someone has a better one, Please post:

Hi,
Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?
Thanks in advance.
Bogdan

Dick Armey, former Republican House Majority Leader and one of the national leaders of the Tea Party activists, had some surprising comments on immigration. From the Arizona Daily Star: Republicans are alienating Hispanic voters with their rhetoric on the immigration issue, former House Majority Leader Dick Armey said Monday. 'These guys are trying to blow it,' Armey, a Texas Republican who now works closely with Tea Party activists, said at a National Press Club luncheon. Armey, one of the creators of the 'Contract with America' that launched the 1994 Republican revolution, says the party needs to be more careful when...

My friend Dan Kowalski linked today to an article in the Detroit Free Press about Naji Chammout, a Lebanese native who has been waiting on his citizenship application to be approved for ten years years. That might surprise people when they learn that Chammout volunteered for the US Army in 2004 when he was a green card holder and served as a translator to top American military commanders in Iraq. He sold his Louisiana gas station for the chance to serve his adopted country and went to some of the most dangerous places in the war zone. US Army Brigadier...
