My client is trying to see if there are any possibilities to bring a graphic artist - flash developer from Phillipines, he currently works freelance and has made a big impression with his work. He has shown interest to come to US on h1b and company wants to know if they have any issues in bringing him onboard by sponsering a h1b. The issue is, he does not have college education, other than that, he qualifies excellent for a job in this company. Will he have issues in getting a h1b? Has anyone got H1b visas with college degrees but only with work experience?

As Silverlight is a browser side technology, you would have no problem serving Silverlight content from our servers as long as you add the proper MIME type settings to the site via .htaccess rules such as:
AddType application/xaml+xml .xaml
AddType application/x-silverlight-app .xap
AddType application/x-ms-xbap .xbap
HTTP responses have a "content-type" as apart of their header.

Examples are JPG, HTML, EXE.
It is advised to set the content type appropriately when you serve a file from your webserver by modiftying your htaccess file. To be honest, you can get away without setting this for all the popular browsers from my experience, but it might affect caching or obscure browsers negatively. There could be other implications, but none that I'm aware of.

Hi,
I have a question regarding Priority Date Re-capture. When a new I-140 is filed requesting priority date re-capture from the old I-140, what happens to the old I-140. I hope the old I-140 is not cancelled. The reason I ask is, if the new I-140 runs into any issues, I don't want to lose the old I-140 as well. Thanks.

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.
Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?
I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.
I cant find anything on the net no this.
There is no problem. I had to do it for same reason i had to work 2-3 months in 2 instances. And for the final time, it was 15 month offshore India assignment. No problems at all.

I have never been to the meeting but will like to attend one if scheduled in future. i think its high time our Chapter schedule meeting with Senators/Congressmen in this area including MD, VA and DC. The President has started the immigration reform initiative and it is right time to make the lawmakers aware of our EB issues. Let me know your thoughts.

It depends on how many cases that will be pending approval on October after the surge of applications this July and August.
I think it wouldn't be current for some countries specifically India and China.

EAD is for work.
AP is for travel. For enter into USA, only AP and passport is required.

I am traveling to India in november and need to get my H1b visa stamped. Somebody told me that as a part of requirement my passport should be valid for 6 months after the visa expiry date. Please advise if this is true.

You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...

Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.
Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?
